hi everyone, i have received a summons to magistrates court from the council, on council headed paper and signed by someone from the "legal services" dept.

 

is this right?

 

can they really {{the LA}} really summons me to court?

 

no letter from the courts no signature or anything infact NO correspondance from the court at all?????

 

not really sure where i stand here??

 

any ideas or advice would be very welcome.

No the council have no business trying to summon you to court. As you've indicated, this letter clearly has nothing to do with the court at all.

 

Personally I would write to the council and point out that this is not a legitimate summons. Remind them that a legitimate summons must be made by a judge in a common law court. I would tell them that if they continue to pursue this matter on an unlawful basis, (and presumably causing you stress) then you will have no alternative but to issue proceedings against them by way of a commercial lien.

Due to recent win(s) and on going case(s).

 

A Council Tax (local tax) summons is NOT a Court summons or any kind.

 

These are corporate summons's.

 

Please note, you must attend the Court at that address on the date/time or they will automatically say you accept;   Ask to see the Senior Clerk at the Court, and ask them to verify the summons (you can do this before the date).

You will find that it is NOT a summons and NO date has been booked at the Court.

 

All real summons's has seal(s), and the person serving and issuer have to have seals.  Failure make the document invalid.  Doing without is a Criminal offence.

The Council will not be able to supply such information about their documentation as they are not willing to tell you and/as they do not have the correct authority or have the correct material to hand in question.

 

You must file and serve on to that corporation who gave you this phoney summons, a defence claim.  At you must state this is a Civil matter and is against your rights, and you will contest their claim(s).

 

PS. for April 2012 onwards – some Councils has sold the rights and the Local Taxation department to a third party corporation; this corporation is a blackop company.  Third parties are not accepted to collect tax or invoice yourself as you have NO contract with them.   Some Councils local taxation documents are now showing these company details not the Councils.   This breeches the Data Protection Act and Contracts Act.

 

Please remember, all of us has to pay a tax or nothing would get done, no road repairs etc.   It is dishonourable to the public to not pay (common).

You must never say you "refuse to pay" always say it "I am not refusing to pay, I would like the correct documents and procedures and invoices to enable my good self to pay".

I have just got one of these for "arrears" for last year. Someone else was living here then and their tax was paid as they were on jobseekers. The council are aware of this.

This being said, If I go and see the senior clerk before the so called summons to verify the document, do I then have to go to court as well?

I have written to the council pointing out that their document is fraudulent and perjurous  under the 1911 perjury act; although I haven't yet heard back from them. I don't expect that they will reply either, before the date on the "summons" which is April 17th.
